Abstrak Pemilihan kepala daerah secara langsung oleh rakyat (pemilukada) adalah salah satu mekanisme yang dianggap demokratis untuk memilih kepala daerah, sebagaimana diatur dalam UU Nomor 32 Tahun 2004 dianggap lebih memberikan kedaulatan kepada rakyat dan hasilnya dianggap memiliki legitimasi yang lebih kuat dibanding dengan pemilihan oleh Dewan Perwakilan Rakyat Daerah. Akan tetapi seiring berjalannya waktu tentunya mekanisme pemilihan tersebut tentunya mempunyai sisi positif dan negatifnya terhadap keberlangsungan berjalannya pemerintahan daerah sebab dalam pemerintahan daerah terdapat dua lembaga yakni Kepala Daerah dan Dewan Perwakilan Rakyat Daerah yang mana posisinya sebagai penyelenggara dalam suatu pemerintahan daerah. Hal yang menjadi perhatian kemudian proses pemilihan pengangkatan kedua lembaga daerah tersebut yang tidak bersamaan sehingga menibulkan prinsip Check and balances dalam pemerintahan daerah tercapai dengan maksimal.

Abstract Direct election of regional heads by the people (Pemilukada) is one of them a mechanism that is considered democratic to elect regional heads, as regulated in Law Number 32 Year 2004 it is considered that it gives more sovereignty to the people and the result is considered to have stronger legitimacy than the election by Regional People's Representative Assembly. But over time, of course the election mechanism certainly has positive and negative sides to it the continuity of the running of regional government because there are local governments two institutions namely the Regional Head and the Regional People's Representative Council its position as administrator in a regional government. Thing to be attention then the process of selecting the appointment of the two regional institutions not simultaneously so that the principle of Check and balances in government is reflected area reached to the maximum.
