ABSTRAK Pada hari SENIN tanggal 10 DESEMBER 2018 sekitar pukul 18.00 Wib atau setidak-tidaknya pada suatu waktu lain dibulan Desember Tahun 2018 bertempat di Jalan Dr.Soetomo Lrg. Ampera Rt.030 Rw.009 Kelurahan Baturaja Lama Kecamatan Baturaja Timur Kabupaten Ogan Komering Ulu atau setidak-tidaknya pada suatu tempat yang masih termasuk daerah hukum Pengadilan Negeri Baturaja yang berwenang memeriksa dan mengadili. Dalam dakwaannya penuntut umum mendakwa terdakwa dengan dakwaan primair Pasal 114 ayat (2) Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika dan Subsidair melanggar Pasal 112 ayat (2) Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika ; Maka dapat disimpulkan bahwa {ertimbangan Majelis hakim dalam putusaan Nomor 184/PID.Sus/2019/PN.Bta tidak tepat. Karena dalam hal ini hakim membebaskan terdakwa dari segala tuntutan Jaksa Penuntut umum dan juga menyatakan terdakwa tidak terbukti secara sah dan menyakinkan bersalah melakukan perbuatan pidana sebagaimana yang didakwakan oleh jaksa penuntut umum di dalam dakwaannya tersebut. Tetapi hakim memutus bebas terdakwa dan menyakinkan tidak terbukti sesuai dengan apa yang telah didakwakan oleh JPU di dalam persidangan Kata Kunci: Putusan bebas, Tindak Pidana Narkotika
