ABSTRAK Di dalam Putusan Nomor 25/Pid.Sus/2020/PN.Mkd pada hari kamis tanggal 24 oktober 2019 sekira pukul 14.00 WIB atau pada waktu lain sekitar bulan oktober 2019 bertempat dirumah terdakwa ANASTASIA VANYA WINDHAYANI Binti WIDODO di perum perumahan Laguna Residence Blok Kalimantan Rt.01 Rw.13 Desa Jogonegoro, kecamatan Mertoyudan , kabupaten magelang atau pada suatu tempat lain yang termasuk dalam daerah hukum Pengadilan Negri Mungkid yang berwenang menangani dan mengadili perkaranya telah terjadi Tindak pidana praktik kedokteran “dengan sengaja menggunakan alat,metode atau cara lain dalam memberikan pelayanan kepada Masyarakat yang menimbulkan kesan seolah-olah yang bersangkutan adalah dokter gigi yang telah memiliki surat tanda registrasi dokter gigi atau surat izin praktik” Melihat pada Kasus Putusan Nomor 25/Pid.Sus/2020/PN.Mkd terdapat didalam putusan ini pertimbangan Majelis Hakim kurang tepat dikarenakan terdakwa telah diputus Pidana percobaan Pasal 14 (a) atas dakwaan ke dua Penuntut Umum mengakibatkan Pidana yang dijatuhkan tidak usah dijalani kecuali apabila terdakwa melakukan perbuatan pidana sebelum masa percobaan berakhir yaitu Pasal 73 ayat (2) Undang-Undang praktik kedokteran hakim memberikan pertimbangan selain dalam keadaan memberatkan dan meringankan majelis hakim juga mempertimbangkan keadaan khusus yaitu: Akibat yang dapat ditimbulkan dari pemidanaan terkait dengan penyebaran COVID-19 (Coronavirus disease) dilembaga pemasyarakatan karena sebelumnya terdakwa adalah tahanan kota yang aktif berinteraksi dengan masyarakat luas maka dari itu tujuan pemidanaan agat terdakwa tidak mengulangi kesalahannya kembali dan dapat memperbaiki perilaku agat diterima nantinya ditengah masyarakat atas keadaan tersebut terdakwa perlu diterapkan pidana percobaan sebagaimana telah ditentukan dalam pasal 14 (a) Kitab Undang-Undang Hukum Pidana. Pertimbangan hakim tidak memberikan dasar hukum yang jelas dan peraturan tentang PERMENKUMHAM Nomor M.HH-19.PK.01.04.04 Tahun 20202 ditunjukkan kepada Narapidana yang menjalani 2/3 masa pidana sedangkan didalam putusan ini masih berstatus terdakwa yang menjalani proses hukum dan baru saja dieksekusi hukuman oleh Majelis Hakim, pertimbangan hakim juga tidak sesuai dengan Pasal 56 KUHAP.
