Paska reformasi pelaksanaan perlindungan hak asasi manusia tidak cukup membaik. Pelanggan hak asasi manusia tidak hanya menyasar korban tetapi juga menyarasar Pembela Ham. Semakin banyaknya pelanggaran terhadap pembela Ham, mendasari Komnas ham untuk membuat peraturan Komnas ham nmomor 5 tahun 2015 tentang prosedur perlindungan bagi Pembela ham. Namun, peraturan tersebut tidak dilandasi dengan kewenangan Komnas Ham. Berdasarkan permasalahan tersebut maka perlu kiranya dilakukan kajian yang komprehensif terhadap permasalahan tersebut sehingga rumusan masalah dalam penelitian ini bagaimana Kedudukan Hukum Peraturan Komnas Ham Nomor 5 tahun 2015 yang mengatur Perlindungan Hukum bagi Pembela Ham dan konsep pengaturan perlindungan Pembela Ham dimasa mendatang. Metode Penelitian yang digunakan yakni penelitian normatif (Normative legal research) dengan pendekatan Perundang-undangan dan Konsep. Hasil Penelitian Peraturan Komnas HAM tentang Prosedur Perlindungan Pembela Ham tidak dapat dikategorikan sebagai Peraturan Perundang-undangan, dikerenakan perkom tersebut tidak dilandasi oleh Peraturan Perundang-undangan yang lebih tinggi dan dibentuk tidak berdasarkan oleh kewenangan dari Komnas HAM sendiri. Adanya ketidak jelasan bentuk perlindungan dalam Peraturan Komnas HAM tentang Prosedur Perlindungan Pembela Ham karena hanya memberikan rekomendasi kepada Lembaga lain untuk memberikan perlindungan. Perlindungan atas Pembela HAM sangat penting. Sehingga perlu ada peraturan perundang-undangn yang mengatur terkait hal tersebut. Maka di masa yang akan datang Perlindungan Pembela HAM harus diatur di dalam Undang-undang. Bentuk Perlindungan terhadap Pembela HAM di masa yanga akan datang dapat berupa : Perlindungan Fisik, Perlindungan hukum, Bantuan Medis, Psikologis, dan Psikososial, dan Fasilitasi Restitusi dan Kompensasi.

More and more violations of human rights, Komnas HAM to make Komnas HAM regulation number 5 of 2015 concerning procedures for protection for human rights defenders. However, the regulation is not based on the authority of Komnas HAM. Based on these problems, it is necessary to carry out a comprehensive study of these problems so that the formulation of the problem in this research is how the Legal Position of Komnas HAM Regulation Number 5 of 2015 which regulates Legal Protection for Human Rights Defenders and the concept of protection for Human Rights Defenders in the future. The research method used is normative legal research with an approach to legislation and concepts. The results of the research on Komnas HAM Regulations concerning Procedures for the Protection of Human Rights Defenders cannot be categorized as Legislative Regulations, because the Perkom is not based on higher laws and regulations and was formed not based on the authority of Komnas HAM itself. There is an unclear form of protection in the Komnas HAM Regulation on Procedures for the Protection of Human Rights Defenders because it only provides recommendations to other institutions to provide protection. The protection of human rights defenders is very important. So there is a need for legislation that regulates this. So in the future the protection of human rights defenders must be regulated in law. The forms of protection for human rights defenders in the future can be in the form of: Physical Protection, Legal Protection, Medical, Psychological, and Psychosocial Assistance, and Facilitation of Restitution and Compensation.
