ABSTRAK Akibat dari adanya pandemi Covid-19 menyebabkan perekonomian dunia lumpuh total. Berbagai bidang usaha di Indonesia sedang mengalami krisis yang sangat mengancam negara, khususnya pada bidang usaha pariwisata di berbagai wilayah, termasuk pula di Pulau Madura. Jutaan pekerja atau buruh sangat rentan untuk kehilangan pekerjaan dan pendapatan mereka. Dalam Undang-Undang Nomor 13 Tahun 2003 Pasal 1 angka 25 dijelaskan bahwa Pemutusan Hubungan Kerja (PHK) merupakan pengakhiran hubungan kerja karena satu hal tertentu yang mengakibatkan berakhirnya hak dan kewajiban antara buruh/pekerja dan pengusaha. Penelitian yang dilakukan adalah penelitian Empiris, yaitu penelitian yang menggunakan data-data lapangan sebagai sumber data utama, seperti hasil wawancara dan observasi dengan maksud untuk mengetahui dan menemukan data dan fakta yang dibutuhkan mengenai permasalahan pemenuhan hak pekerja atas Pemutusan Hubungan Kerja (PHK). Penelitian ini menggunakan pendekatan kualitatif, yaitu suatu cara analisis hasil dari penelitian yang menghasilkan data Deskriptif analisis, merupakan data yang dinyatakan oleh responden secara tertulis ataupun berupa lisan, serta juga tingkah laku yang nyata, yang diteliti dan dipelajari sebagai suatu yang utuh. Hasil penelitian menunjukkan bahwa PHK yang dilakukan oleh perusahaan di bidang usaha pariwisata di kabupaten Bangkalan sudah sesuai dengan Undang-Undang Ketenagakerjaan. PHK memiliki beberapa prosedur yang harus dipatuhi oleh perusahaan. Pertama-tama dilakukan musyawarah dengan pihak karyawan dan perusahaan. Musyawarah bertujuan untuk mendapatkan pemufakatan yang dikenal dengan istilah bipartit. Jika proses musyawarah telah mencapai suatu kesepakatan maka hal ini dituangkan dalam Surat Perjanjian Bersama dan ditandatangani oleh kedua belah pihak dan didaftarkan ke PHI setempat. Terakhir jika terjadi pemutusan hubungan kerja, yaitu perusahaan wajib memberikan uang pesangon atau uang penghargaan masa kerja yang seharusnya diterima oleh karyawan. Pemenuhan hak-hak bagi pekerja yang di PHK pada bidang usaha pariwisata di Kabupaten Bangkalan belum sepenuhnya terpenuhi, Ada beberapa hak para pekerja yang di PHK yang belum mereka dapatkan, misalnya uang penggantian hak karyawan yang harus diberikan kepada pekerja sebagai uang ganti rugi terhadap hak-hak yang belum diambil oleh pekerja/karyawan. ABSTRACK As a result of the Covid-19 pandemic, the world economy has been completely paralyzed. Various business fields in Indonesia are experiencing a crisis that threatens the country, especially in the tourism business sector in various regions, including on the island of Madura. In Law Number 13 of 2003 Article 1 number 25 it is explained that Termination of Employment (PHK) is the termination of the employment relationship due to one particular thing which results in the termination of the rights and obligations between the worker/worker and the entrepreneur. The research conducted is empirical research, namely research that uses field data the main data source, such the results of interviews and observations with the aim of knowing and finding the data and facts needed regarding the issue of fulfilling workers rights to Termination of Employment (PHK). This study uses a qualitative approach, which is a way of analyzing the results of research that produces descriptive analysis data, which is data stated by the respondent in writing in the form of oral, well real behavior, which is researched and studied a whole. The results showed that layoffs carried out by companies in the tourism business sector in Bangkalan district were in accordance with the Manpower Act. Layoffs have several procedures that companies must comply with. First of all, consultations are carried out with the employees and the company. Deliberation aims to obtain an agreement known bipartite. If the deliberation process has reached an agreement then this is stated in a Collective Agreement and signed by both parties and registered with the local PHI. Finally, if there is a termination of employment, the company is obliged to provide severance pay service pay that should be received by the employee.
