ABSTRAKrnrnNotaris merupakan pejabat yang diangkat oleh negara untuk mewakili kekuasaan umum negara dalam melakukan pelayanan hukum kepada masyarakat dalam bidang hukum perdata demi terciptanya kepastian, ketertiban, dan perlindungan hukum. Menurut Pasal 8 ayat (1) UUJN bahwa Notaris bisa berhenti atau diberhentikan dari jabatannya dikarenakan meninggal dunia. Pasal 35 UUJN mengatur bahwa apabila Notaris meninggal dunia ada kewajiban keluarga atau ahli waris Notaris yang harus dilaksanakan, yaitu berkewajiban untuk memberitahukan kepada Majelis Pengawas Daerah (MPD) bahwa Notaris yang bersangkutan telah meninggal dunia. Permasalahan penelitian ini meliputi ahli waris notaris yang tidak memberitahukan kematian notaris dalam waktu 7 hari dan pertanggungjawaban hukumnya apabila ahli waris notaris juga meninggal dunia akibat dampak covid-19. Jenis penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, dimana penelitian ini dilakukan dengan tujuan untuk memberikan argumentasi hukum sebagai dasar pentingnya pengaturan hukum serta untuk memberikan unsur keadilan dan kepastian hukum. Penelitian ini menghasilkan Pertama, pertanggungjawaban hukum jika ahli waris notaris juga meninggal dunia akibat covid-19, maka berdasarkan Pasal 22 ayat (1) Permenkumham No. M.01-HT.03.01 Tahun 2006 tentang Syarat dan Tata Cara Pengangkatan, Perpindahan, Perpanjangan dan Pemberhentian Notaris, yang wajib memberitahukan kematian notaris kepada MPD yakni ahli waris golongan kedua. Kedua, dalam waktu 7 hari ahli waris notaris tidak memberitahukan kematian notaris kepada MPD, maka akibat hukumnya protokol notaris tersebut dapat diambil oleh MPD.rnrnKata Kunci: Notaris, Ahli Waris Notaris, Akibat Hukum, Pertanggungjawaban Hukum

ABSTRACTrnNotaries are officials appointed by the state to represent the general power of the state in providing legal services to the public in the field of civil law in order to create certainty, order and legal protection. According to Article 8 paragraph (1) UUJN that a Notary can quit be dismissed from his position due to death. Article 35 of the UUJN stipulates that if a Notary dies, there are obligations of the family heirs of the Notary that must be carried out, namely the obligation to notify the Regional Supervisory Council (MPD) that the Notary concerned has died. The problems of this research include the notary's heirs who do not notify the notary's death within 7 days and their legal liability if the notary's heir also dies due to the impact of covid-19. This type of research is a normative legal research with a statutory approach, where this research is carried out with the aim of providing legal arguments the basis for the importance of legal regulation and to provide elements of justice and legal certainty. This research produces first, legal liability if the heir of a notary also dies due to covid-19, then based on Article 22 paragraph (1) of the Minister of Law and Human Rights No. M.01-HT.03.01 of 2006 concerning Terms and Procedures for Appointment, Transfer, Extension and Dismissal of a Notary, who is obliged to notify the death of a notary to the MPD, namely the heirs of the second group.
