[ Anotasi Abstrak ]
Deskripsi Lain
ABSTRACT The press is the fourth pillar of democracy after the executive, legislature and judiciary. In carrying out its role, the press has freedom stipulated in the Press Law and the 1945 Constitution. The existence of the PDP Law is expected to be the basis for protecting citizens and government officials. However, the PDP Law contains several articles that can be easily misused to the detriment of citizens, including journalists. Article 4 paragraph 2 of the PDP Law states that crime records are a type of personal data, which can certainly hinder the performance of journalists to reveal public crime records. Article 64 paragraph 2 also explains that PDP dispute resolution is carried out behind closed doors and this is contrary to the spirit of public information disclosure. Thus, it is possible that there is a vagen of norms between the PDP Law and the 1945 Constitution and the Press Law that support press freedom. The research method used is Normative Legal Research (Legal Research). The approach used is the approach to legislation (Statute Approach). The sources of legal materials used are primary and secondary legal materials. Data collection tools use literature study and use deductive logic analysis. The result of this research is that there is a vagen of norms between the PDP Law and the Press Law, causing the freedom of the press which is supported by the 1945 Constitution and the Press Law to be hampered. However, with the democratic system and the application of the principle of legal preference, namely lex specialis derogat legi generali and lex superior derogat legi inferiori, which prioritizes the 1945 Constitution and the Press Law the legal basis, the freedom of the press is not hampered by the PDP Law. This is also based on the importance of public information disclosure which is the basis for supporting press freedom in Indonesia.rnKeywords: Freedom of the Press, Public Information, Personal Data.
