ABSTRAKrnrnJustice collaborator adalah setiap orang yang berperan sebagai pelaku tindak pidana atau diyakini merupakan bagian dari tindak pidana dilakukan secara bersama-sama atau kejahatan terorganisir, tetapi bersedia untuk bekerjasama dengan penegak hukum dengan cara memberikan kesaksian mengenai bentuk-bentuk tindak pidana menyangkut kejahatan terorganisir atau kejahatan serius lainnya.rnIsu hukum dalam peneletian ini adalah apa konsep justice collaborator menurut Pasal 10 dan 10a Undang-Undang Nomor 31 Tahun 2014 Tentang Perlindungan Saksi dan Korban, serta apa konsep justice collaborator dalam putusan Pengadilan Jakarta Selatan pada perkara Nomor 798/Pid.B/2022/PN.Jkt.Sel. Dalam penulisan tesis ini, jenis penelitian yang digunakan adalah penelitian normatif.rnHasil penelitian menjelaskan bahwa Konsep justice collaborator menurut Pasal 10 dan 10A Undang-Undang Nomor 31 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban, adalah: (a) harus memenuhi unsur subjektif, yaitu bukan pelaku utama dalam tindak pidana. Bukan orang yang memiliki rencana untuk melakukan tindak pidana pembunuhan berencana. Adanya ancaman yang serius atau ancaman keselamatan terhadap saksi pelaku dan keluarganya, baik secara psikis atau fisik. (b) harus memenuhi unsur objektif, yaitu mau berkata jujur, konsisten dalam memberikan kesaksian di pengadilan. Nilai konsistensi dan iktikad baik dari saksi pelaku di muka pengadilan berimplikasi pada pemberian penghargaan sebagai justice collaborator. Adapun konsep justice collaborator dalam putusan Pengadilan Jakarta Selatan pada perkara Nomor 798/Pid.B/2022/PN.Jkt.Sel, adalah sebagai berikut: (1) terdakwa bukan pelaku utama. Artinya, terdakwa dalam melakukan tindak pidana pembunuhan berencana di perintah oleh Ferdy Sambo. (2) terdakwa mendapatkan rekomendasi dari LPSK. Dalam mengungkap suatu peristiwa tindak pidana, terdakwa dalam keadaan yang membahayakan dapat mengancam jiwa dan keluarganya. (3) adanya pengakuan dari terdakwa bahwa perbuatannya sangat jahat, menyadari, menyesal, meminta maaf kepada keluarga korban. Not a person who has a plan to commit a crime of premeditated murder. There is a serious threat threat to the security of the witness and his family, either psychologically physically. (b) must meet objective elements, namely being willing to tell the truth, be consistent in giving testimony in court. The value of consistency and good faith from the witnesses of the perpetrators before the court has implications for awarding them justice collaborators. The concept of justice collaborator in the South Jakarta Court's decision in case Number 798/Pid.B/2022/PN.Jkt.Sel, is follows: (1) the defendant is not the main actor. This means that the defendant in committing the crime of premeditated murder was ordered by Ferdy Sambo. (2) the defendant obtained a recommendation from the LPSK. In disclosing a criminal act, the defendant is in a dangerous situation that can threaten the life and his family. (3) there was an acknowledgment from the defendant that his actions were very evil, realized, regretted, apologized to the victim's family.
