Diundangkannya Undang-Undang Nomor 6 Tahun 2014 tentang Desa merupakan awal baru terkait dengan pengisian anggota Badan Permusyawaratan Desa (BPD). Terlihat jelas dalam aturan tersebut pengisian anggota BPD dapat dilakukan melalui pemilihan langsung secara demokratis. Hal ini sebagai bentuk nyata dari adanya penerapan demokrasi dan demokratisasi di tingkat desa. Pengisian anggota BPD yang dipilih melalui pemilihan langsung secara demokratis menimbulkan permasalahan baru. Mulai dari adanya bentuk kecurangan hingga intervensi dari pihak tertentu dalam proses pemilhan yang tentunya hal ini berimplikasi pada hasil pemilihan anggota BPD nantinya. Sehingga perselisihan terhadap hasil pemilihan anggota BPD yang dipilih melalui pemilihan langsung tidak dapat dihindarkan karena hal tersebut sangat merugikan pihak prinsipal calon anggota BPD. Sejauh ini dalam peraturan perundang-undangan terkait dengan BPD, belum memberikan kepastian hukum terkait dengan upaya hukum apa yang dapat ditempuh oleh calon anggota BPD apabila sewaktu-waktu terdapat perselisihan hasil pemilihan tersebut. Hal ini diakrenakan belum adanya pengaturan secara pasti terkait konsep penyelesaian perselisihan hasil pemilihan anggota BPD yang dipilih melalui pemilihan langsung dalam peraturan perundang-undangan di Indonesia. Isu hukum terkait dengan kepastian hukum penyelesaian perselisihan hasil pemilihan anggota BPD yang dipilih melalui pemilihan langsung tersebut diteliti dengan menggunakan metode penelitian hukum normatif dengan melakukan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan sejarah. Hal ini dilakukan guna menghasilkan suatu jawaban terkait dengan isu hukum yang diangkat secara komprehensif. Hasil penelitian ini menunjukkan bahwa, untuk memberikan kepastian hukum terhadap calon annggota BPD yang merasa dirugikan haknya terkait dengan adanya perselisihan hasil pemilihan anggota BPD yang dipilih melalui pemilihan langsung, harus ada perubahan pengaturan dalam materi muatan Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Pengaturan terkait dengan konsep kewenangan yang dimiliki oleh Bupati/Walikota selaku kepala daerah dalam menyelesaikan perselisihan hasil pemilihan Kepala Desa, dapat juga kemudian diterapkan terhadap perselisihan hasil pemilihan BPD. Mengingat, secara teoritis dan yuridis kedudukan antara BPD dan Kepala Desa sejajar dalam menjalankan fungsinya pada tingkat pemerintahan desa.

The regulation of Law Number 6 Year of 2014 concerning Villages is a new beginning in relation to the filling of members of the Village Consultative Body (BPD). It is clear in the regulation that the filling of BPD members can be done through direct democratic elections. This is a tangible form of the implementation of democracy and democratization at the village level. The filling of BPD members selected through direct democratic elections raises new problems. Starting from the existence of forms of fraud to the intervention of certain parties in the election process, which of course has implications for the results of the election of BPD members later. So that disputes over the results of the election of BPD members elected through direct elections can not be avoided because it is very detrimental to the principle of prospective BPD members. So far, the legislation related to BPD has not provided legal certainty regarding what legal remedies can be taken by prospective BPD members if at any time there is a dispute over the election results. This is due to the absence of definite arrangements related to the concept of resolving disputes over the election results of BPD members elected through direct elections in Indonesian legislation. The legal issu’s related to the legal certainty of resolving disputes over the results of the election of BPD members elected through direct elections are researched using normative legal research methods/doctrinal legal research methods by taking a statutory approach, conceptual approach, and historical approach. This is done in order to produce an answer related to the legal issues raised comprehensively. The results of this research indicate that, in order to provide legal certainty to candidates for BPD members who feel their rights are disadvantaged in relation to disputes over the election results of BPD members elected through direct elections, there must be regulatory changes in the content material of Law Number 6 year of 2014 concerning Villages. Arrangements related to the concept of authority owned by the Regent/Mayor the head of the region in resolving disputes over the results of the election of the Village Head can also be applied to disputes over the results of the BPD election. Given, theoretically and juridically the position between the BPD and the Village Head is equal in carrying out its functions at the village government level.
