disusun oleh WAFIQ MAHSHUN
| Subyek: | Hak Pengelolaan Tanah Ulayat Masyarakat Hukum Adat Permen ATR/BPN No. 14 Tahun 2024 UUPA. |
| Kata Kunci: | Hak Pengelolaan Tanah Ulayat Masyarakat Hukum Adat Permen ATR/BPN No. 14 Tahun 2024 UUPA. |
[ Anotasi Abstrak ]
Deskripsi Lain
Customary rights (hak ulayat) are communal rights of indigenous peoples (Masyarakat Hukum Adat/MHA) that are constitutionally recognized through Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia and Article 3 of Law Number 5 of 1960 concerning Basic Agrarian Principles (UUPA). The enactment of Ministerial Regulation of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) Number 14 of 2024 concerning the Implementation of Land Administration and Land Registration of Customary Land Rights of Indigenous Peoples introduces a mechanism for granting Land Management Rights (HPL) over customary land, which raises juridical issues concerning the protection of communal rights of indigenous peoples. This research aims to analyze the conformity of granting HPL derived from customary land with the provisions of Article 3 of the UUPA, well to examine the juridical implications of ATR/BPN Ministerial Regulation No. 14 of 2024 on the protection of indigenous peoples’ rights.rnThis research employs a normative legal research method using a statutory approach and a conceptual approach, with deductive syllogism analysis techniques. The results of the research indicate that the granting of HPL over customary land has the potential to eliminate the status of customary land and shift the communal nature of customary rights, thereby conflicting with the recognition of customary rights under Article 3 of the UUPA. In terms of its implications, ATR/BPN Ministerial Regulation No. 14 of 2024 transforms the recognition of customary rights from a form of living law into a right that depends on state administrative mechanisms. The provisions of Article 15 paragraph (1), which allow applications for HPL over registered customary land, and Article 16 paragraph (2), which permits cooperation with third parties, normatively weaken the constitutional recognition of customary rights and create legal loopholes that may be exploited by parties outside indigenous communities.
