ABSTRAKrnKegiatan investasi di sektor wisata bahari memiliki peran strategis dalam menggerakkan perekonomian daerah, namun berpotensi menimbulkan dampak negatif terhadap hak-hak ekologis serta sosio-ekonomi masyarakat pesisir apabila tidak diimbangi dengan mekanisme pemantauan dan akuntabilitas hukum yang memadai. Penelitian ini mengkaji dua rumusan masalah utama, yakni ketersediaan dan efektivitas instrumen regulasi Pemerintah Daerah Kabupaten Pamekasan dalam pemantauan akuntabilitas investasi wisata bahari guna melindungi hak masyarakat pesisir di Desa Tanjung, serta bentuk peran aktif masyarakat lokal dalam mengawal implementasi kebijakan investasi dan menjaga keberlanjutan wilayah pesisir. Metode penelitian yang digunakan adalah penelitian hukum empiris melalui pendekatan fakta (fact approach), dengan teknik pengumpulan data berupa wawancara lapangan dan studi kepustakaan, yang dianalisis secara deduktif. Hasil penelitian menunjukkan bahwa Pemerintah Daerah Kabupaten Pamekasan telah memiliki dasar regulasi sektoral seperti aturan RTRW, perizinan berusaha, dan dokumen lingkungan (AMDAL/UKL-UPL), namun belum menetapkan Peraturan Daerah khusus yang secara spesifik mengatur akuntabilitas teknis investasi wisata bahari, sehingga memicu legal gap dalam perlindungan hak masyarakat pesisir. Sementara itu, masyarakat Desa Tanjung menjalankan peran aktif melalui pengelolaan wisata berbasis komunitas bersama BUMDes Jumiang dan Pokdarwis, serta melakukan pengawasan sosial partisipatif dan penyampaian aspirasi secara berkala. Kesimpulannya, instrumen regulasi di Kabupaten Pamekasan masih bersifat sektoral sehingga memerlukan pembentukan Perda khusus pariwisata bahari, sedangkan masyarakat lokal telah berhasil mengawal implementasi kebijakan secara mandiri demi mempertahankan keseimbangan lingkungan dan hak ekonomi wilayah pesisir.rnKata Kunci: Akuntabilitas, Investasi Wisata Bahari, Masyarakat Pesisir, Perlindungan Hak.

ABSTRACTrnInvestment activities in the marine tourism sector play a strategic role in driving the local economy; however, they have the potential to negatively impact the ecological and socioeconomic rights of coastal communities if not balanced by adequate monitoring mechanisms and legal accountability. This study examines two main research questions: the availability and effectiveness of regulatory instruments implemented by the Pamekasan Regency Government in monitoring the accountability of marine tourism investments to protect the rights of coastal communities in Tanjung Village; and the forms of active participation by local communities in overseeing the implementation of investment policies and safeguarding the sustainability of coastal areas. The research method employed is empirical legal research using a fact-based approach, with data collection techniques consisting of field interviews and a literature review, analyzed deductively.rnThe research findings indicate that the Pamekasan Regency Government already possesses sectoral regulatory frameworks, such the Spatial Planning Regulation (RTRW), business licensing regulations, and environmental impact assessment documents (AMDAL/UKL-UPL); however, it has not yet enacted a specific local regulation that explicitly governs the technical accountability of marine tourism investments, thereby creating a legal gap in the protection of coastal communities’ rights. Meanwhile, the residents of Tanjung Village play an active role through community-based tourism management in collaboration with the Jumiang Village-Owned Enterprise (BUMDes) and the Tourism Awareness Group (Pokdarwis), well by conducting participatory social oversight and regularly voicing their concerns. In conclusion, regulatory instruments in Pamekasan Regency remain sectoral in nature, necessitating the enactment of a specific local regulation on marine tourism, while local communities have successfully independently monitored policy implementation to maintain environmental balance and safeguard the economic rights of coastal areas.rnKeywords: Accountability, Marine Tourism Investment, Coastal Communities, Protection of Rights.
