Pelaksanaan eksekusi terhadap putusan pengadilan yang telah berkekuatan hukum tetap merupakan tahapan akhir dalam penyelesaian perkara perdata yang bertujuan memberikan kepastian hukum kepada pihak yang memenangkan perkara. Akan tetapi, dalam praktiknya pelaksanaan eksekusi sering menghadapi berbagai hambatan, salah satunya adanya bantahan dari pihak ketiga yang merasa memiliki kepentingan terhadap objek sengketa. Penelitian ini bertujuan untuk mengkaji keabsahan pelaksanaan eksekusi atas tanah dan bangunan yang berlokasi di Dusun Legung, Desa Dumajeh, Kecamatan Tanah Merah, Kabupaten Bangkalan berdasarkan Putusan Nomor 13/Pdt.G/2022/PN.Bkl setelah adanya bantahan pihak ketiga dalam perkara Nomor 19/Pdt.Bth/2025/PN.Bkl, serta menganalisis bentuk perlindungan hukum yang diberikan kepada pemohon eksekusi terhadap objek sengketa tersebut.rnMetode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum yang digunakan terdiri dari peraturan perundang-undangan, putusan pengadilan, serta literatur hukum yang relevan. Selanjutnya, bahan hukum tersebut dianalisis secara kualitatif untuk mengkaji ketentuan hukum mengenai pelaksanaan eksekusi dan bantahan pihak ketiga..rnHasil penelitian menunjukkan bahwa pelaksanaan eksekusi tetap sah selama putusan yang menjadi dasar eksekusi telah berkekuatan hukum tetap, meskipun terdapat bantahan dari pihak ketiga melalui upaya perlawanan (derden verzet). Perlindungan hukum terhadap pemohon eksekusi diberikan melalui kepastian pelaksanaan putusan pengadilan, pengamanan objek eksekusi, serta jaminan pelaksanaan sesuai ketentuan hukum acara perdata yang berlaku.

The execution of a legally binding court decision is the final stage in resolving a civil case, aiming to provide legal certainty to the winning party. However, in practice, the execution process often faces various obstacles, one of which is objections from third parties who claim to have an interest in the disputed object. This study aims to examine the validity of the execution of the land and buildings located in Legung Hamlet, Dumajeh Village, Tanah Merah District, Bangkalan Regency, based on Decision Number 13/Pdt.G/2022/PN.Bkl following the objection of a third party in Case Number 19/Pdt.Bth/2025/PN.Bkl. It also analyzes the legal protection provided to the applicant for the execution of the disputed object.rnThe research method used is normative legal research with a statutory and case-based approach. The legal materials used consist of laws and regulations, court decisions, and relevant legal literature. Next, the legal materials were analyzed qualitatively to examine the legal provisions regarding the implementation of the execution and third-party objections.rnThe results of the study indicate that the execution remains valid long the decision serving the basis for the execution has permanent legal force, even if there is a objection from a third party through a countermeasure (derden verzet). Legal protection for the applicant for execution is provided through certainty of the implementation of the court decision, security of the object of execution, and guarantees of implementation in accordance with applicable civil procedural law.
