ABSTRAK Ide pembentukan DPD dimaksudkan untuk mengakomodasi aspirasi daerah, yang selama ini kepentingan daerah hanya diwakili oleh utusan daerah yang lebih banyak di tunggangi oleh kepentingan politik di MPR, Ide tersebut di tentang oleh para kelompok partai politik yang tidak ingin kekuasaan politiknya di parlemen menjadi kecil, sehingga kewenangan DPD sebagai lembaga legislatif tidak maksimal, dikarenakan DPD hanya bisa mengusulkan rancangan Undang-Undang, tidak bisa membentuk Undang-Undang seperti DPR. Dari permasalahan tersebut ada (2) dua permasalahan yang mendorong saya untuk melakukan penelitian ini, yang pertama, kedudukan DPD dalam sistem ketatanegaraan indonesia dan yang kedua rekonstruksi kewenangan DPD sebagai lembaga legislatif. Tujuan penelitian ini adalah Untuk menganalisa kedudukan DPD dalam sistem ketatanegaraan di Indonesia. Bahwa setelah diketahui kedudukan DPD dalam sistem ketatanegaraan di Indonesia maka akan di ketahui fungsi dan kewenangan DPD sebagai lembaga legislatif di indonesia. Metode yang digunakan adalah penelitian hukum normatif melalui pendekatan Perundang-undangan dan pendapat para ahli. Hasil penelitian menunjukkan bahwa kedudukan DPD dalam sistem ketatanegaraan indonesia adalah sebagai lembaga penunjang bukan lembaga legislatif, selain itu perlu adanya rekonstruksi kewenangan DPD melalui amandemen UUD 1945.

Abstract The idea of the DPD establishment is intended to accommodate the aspirations in certain region, which only the regional representatives regional interests are allowed to represent the regional interest. The situation is always played in MPR as a political interest. The idea is opposed by the group of political party that does not want their political power in parliament to be small, so DPD authority as the legislature is not optimal because DPD can only propose a draft of law and cannot form laws such as the Representative. Based on this problem there are (2) two issues that push me to do this research, the first, the position of DPD in the state system and secondly, Indonesian reconstruction as the legislative authority of the DPD. The purpose of this study is to analyze the position of DPD in the state system in Indonesia. The functions and authority of the Council as a legislative institution in Indonesia will be revealed after the position of DPD in the state system in Indonesia is clear. The method used is a normative legal research through legislation approach and expert opinions. The results show that the position of DPD in the state system as a supporting institutions Indonesia is not a legislative department. In addition, reconstruction for the authority of the DPD through the 1945 amendment is surely needed.
