Transaksi elektronik merupakan bentuk perdagangan yang mempunyai karakteristik tersendiri dengan menggunakan media internet sebagai sarana penghubungnya. Kondisi tersebut di satu sisi sangat menguntungkan konsumen, namun di sisi lain pelanggaran akan hak – hak konsumen sangat riskan terjadi, maka dari itu sangat diperlukan perlindungan hukum terhadap konsumen dalam transaksi elektronik. Oleh karena itu, penelitian ini bertujuan untuk memaparkan bagaimana proses terjadinya wanprestasi dalam jual beli secara elektronik, dan bagaimana akibat hukumnya. Metode penelitian yang digunakan adalah normatif dengan menggunakan pendekatan peraturan peraturan-perundang-undangan (satuta approach). Hasil penelitian ini menunjukan bahwa pelaksanaan jual beli melalui media internet terdiri dari empat proses, yaitu penawaran, penerimaan, pembayaran, dan pengiriman. menunjukan bahwa dalam perjanjian jual beli melalui transaksi elektronik kesepakatan antara penjual dan pembeli telah terjadi saat dilakukannya “beli” oleh calon pembeli yang merupakan tindakan akseptasi terhadap penawaran penjual, sehingga terjadi pertemuan antara permintaan dan penawaran dalam transaksi tersebut. Sedangkan wanprestasi dalam perjanjian jual beli melalui transaksi e- commerce ini terjadi saat salah satu pihak tidak melaksanakan apa yang telah diperjanjikan. Dalam penelitian ini, wanprestasi lebih berpotensi dilakukan oleh pihak penjual, Hal ini karena bisa saja barang yang menjadi obyek jual beli tidak sesuai dengan penawaran yang dilakukan oleh penjual dalam transaksi elektronik. Terjadinya wanprestasi yang dilakukan oleh penjual, menimbulkan akibat hukum yang mewajibkan penjual harus memenuhi kewajibannya dan mengganti kerugian yang diderita oleh pembeli dalam bentuk; pengantian biaya, ganti rugi dan bunga berdasarkan Pasal 1236 , 1239 ataupun Pasal 1243 BW.
