ABSTRAK Pendafataran tanah harus dilakukan sebagai penjamin bagi pemilik tanah untuk memperoleh perlindungan hukum jika terjadi hal yang tidak diinginkan dikemudian hari. Berkaiatan dengan perwakafan tanah juga harus melalui proses pendafataran tanah wakaf untuk memperolah Akta Ikrar Wakaf yang juga sebagai alat bukti yang kuat karena merupakan akta otentik yang dibuat oleh pejabat yang berwenang. Permasalahan dalam penelitian ini adalah pembuktian mengenai penguasaan hak atas penguasaan tanah wakaf. Penelitian ini menggunakan metode penelitian hukum normatif yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma hukum positif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach). Hasil penelitian ini menunjukkan bahwa sertifikat hak milik dan akta ikrar wakaf merupakan alat bukti yang kuat yang dapat diajukan di muka persidangan jika ada hal yang tidak diinginkan terjadi dikemudian hari. Selain itu adanya akibat hukum yang terjadi atas pelaksanaan perwakafan atas tanah tersebut seperti perubahan status hak milik, dan tidak adanya tanggung jawab untuk membayar Pajak Bumi dan Bangunan
