Asas legalitas merupakan hal terpenting dalam hukum pidana dan menjadi tolak ukur menyatakan suatu perbuatan dapat dikatakan sebagai tindak pidana atau tidak. Prinsip asas legalitas sendiri mengandung pengertian bahwa tidak ada suatu perbuatan dikatakan perbuatan pidana dapat di pidana kecuali atas kekuatan yang telah ditetapkan dalam undang-undang yang telah di atur sebelum dilakukan perbuatan tersebut. Problematika utama ajaran sifat melawan hukum materill fungsi yang positif karena ajaran ini menginginkan perbuatan yang tidak di atur dalam undang-undang namun dalam nilai keadilan dalam masyarakat perbuatan tersebut dikatakan perbuatan pidana sehingga perbuatan tersebut patut dipidana. Untuk itu saya menulis skripsi dengan judul keberlakuan sifat melawan hukumnya perbuatan pidana dalam perspektif asas legalitas. Metode penelitian menggunakan pendekatan Conseptual approach dan pendekatan historis. Hasil dari penelitian ini bahwa ajaran sifat melawan hukum dalam fungsi yang positif tidak akan pernah diterapkan selama ada asas legalitas yang menjadi keterbatasan ajaran sifat melawan hukum fungsi yang positif karena asas legalitas hanya berpedoman kepada undang-undang saja sehingga asas legalitas tampak kaku. Untuk mengurangi kekakuan asas legalitas diperlukan konsep yuridical correction. Yang bertujuan agar perbuatan yang diluar undang-undang dapat diatur tidak hanya berpedoman kepada undang-undang saja. Kata kunci: Asas legalitas, sifat melawan hukum materil positif.

To reduce the stiffness of the principle of legality is required yuridical concept correction. Which aims to act outside the law can be set not only guided by the law alone.
