[ Anotasi Abstrak ]
Dekrit merupakan keputusan presiden yang merupakan penjelmaan kehendak yang sifatnya sepihak. Lumrahnya dekrit ini dilakukan bilamana negara dalam keadaan darurat/bahaya., Sejarah mencatat bahwa telah terjadi dua peristiwa dekrit presiden yang menghiasi perjalanan politik kepemimpinan di Indonesia, yakni 1. Dekrit presiden Soekarno tanggal 5 Juli 1959 dan 2. Dekrit presiden Abdurrahman Wahid tanggal 23 Juli 2001. Dalam perkembangannya terdapat beberapa ganjalan, pertama, politik hukum apa yang menjadi landasan dikeluarkannya dekrit presiden tersebut mengingat bahwa tidak bisa dipungkiri adanya intervensi politik dalam setiap pembentukan kebijakan dan aturan perundang-undangan khususnya ketika presiden mengeluarkan dekrit. kedua, bagaimana keberlakuan hukum dekrit presiden, karena dekrit tersebut telah terjadi dua kali di Indonesia, Kata Kunci : Dekrit, Presiden, Hukum, Politik.

Decree is a president decision which reflect on one sided will. In general, the decree conducted when a state is facing an internal chaos. A history writes two events of presidential decree in political journey of Indonesia leadership; 1. Presidential Decree of Soekarno in July 5th, 1959 and 2. Presidential Decree of Abdurrahman Wahid in July 23, 2001. There are several obstacles attach on it, first, legal politics become the foundation of issuing the presidential decree considering the undeniable political internvention in forming issues and regulations, especially when president issues a decree. Secondly, a question on the legal validity of presidential decree considering the decree has bees issued twice in Indonesia. Keywords: Decree, President, Law, Politics.
