Esensi atau hakikat dalam pembayaran JHT seperti tertuang dalam Pasal 37 UU Tentang SJSN dapat dibayarkan sekaligus pada saat peserta memasuki usia pensiun, meninggal dunia, atau mengalami cacat total tetap. Hal tersebut juga diperkuat dengan ketentuan Pasal 26 PP Nomor 46 Tahun 2015 Tentang Penyelenggaraan Program JHT. Penelitian yang digunakan dalam penulisan ini adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan perbandingan. Permasalahan yang dibahas dalam penelitian ini adalah : (1) Bagaimana esensi pembayaran JHT yang terkandung dalam ketentuan Pasal 37 UU Tentang SJSN dan (2) Apakah peraturan pelaksanaan terkait pembayaran JHT sudah sesuai dengan ketentuan Pasal 37 UU Tentang SJSN ? Esensi pembayaran manfaat JHT seharusnya diperuntukkan saat memasuki usia pensiun 56 (lima puluh enam) tahun atau masa tidak produktif. Akan tetapi dalam pelaksanaannya terdapat inkonsistensi pengaturan pembayaran JHT antara antara Pasal 37 UU Tentang SJSN dengan PP Nomor 60 Tahun 2015 Tentang Perubahan Atas PP Nomor 46 Tahun 2015 Tentang Penyelenggaraan Program JHT, yang menghapus Pasal 26 ayat (3) PP Nomor 46 Tahun 2015 Tentang Penyelenggaraan Program JHT dan ketentuan Pasal 3 ayat (2) dan ayat (3) huruf a dan huruf b Permenaker Nomor 19 Tahun 2015 Tentang Tata Cara dan Persyaratan Pembayaran Manfaat JHT. The essence or nature payment of the provident fund as set out in Article 37 Constitution of the Law on the Social Security can be paid all at once when the participants reach age of 56 years, die or permanent total disability. It is also supported by the provisions of Article 26 of Government Regulation No. 46 of 2015 About Implementation of The Provident Fund. The research in this paper is a normative juridical research approach to legislation and the comparative approach. The problems discussed in this paper is : (1) How is the essence payment of the Provident Fund contained in the provisions Article 37 Constitution of the Law on the Social Security, and (2) What are the rules governing Implementation payment of the Provident Fund are in accordance with the Article 37 Constitution of the Law on the Social Security? The essence payment of the provident fund should for the participants reach age of 56 years or unproductive period. But in practice there were inconsistencies arrangements about payment of the Provident Fund, between the Article 37 Constitution of the Law on the Social Security by Regulation No. 60 of 2015 on Amendment of Government Regulation No. 46 of 2015 About Implementation of the Provident Fund, which delete Article 26 paragraph (3) of Government Regulation No. 46 of 2015 About Implementation of the Provident Fund and the provisions of Article 3 paragraph (2) and paragraph (3) a and b of Manpower Regulation No.19 of 2015 on the Procedures and Terms of payment of the Provident Fund.
