Penelitian ini penulis susun berdasarkan kasus yang terjadi antara TNI yang berniat mengamankan jatuhnya pesawat Hawk 200 dan wartawan yang hendak meliput kasus jatuhnya pesawat tersebut dan dari kasus tersebut penulis mengkasi dua rumusan masalah Upaya hukum yang dilakukan oleh wartawan tehadap kasus jatunya pesawat hawk 200 dan Ketentuan hukum yang dapat diterapkan terhadap anggota TNI yang melakukan penganiayaan terhadap wartawan atas jatuhnya pesawat Hawk 200 bernomor registrasi TT 0212 milik TNI AU. Metode penulisan skripsi ini merupakan penelitian hukum normatif yang menggunakan metode pendekatan masalah yakni Pendekatan masalah dalam skripsi ini menggunakan pendekatan undang-undang (statute approach) dan pendekatan konseptual (conceptual approach. Kemudian permasalahan yang diangkat penulis di analisis oleh penulis menggunakan metode penelitian hukum normatif yang bersifat analisis deskriptif kualitatif yang dilakukan dengan cara deduktif. Bahan hukum yang digunakan oleh penulis adalah bahan hukum primer berupa peraturan perundang-undangan dan bahan buku sekunder berupa buku literature, jurnal, makalah dan artikel dari internet Dari kajian yang penulis lakukan diketahui bahwa upaya hukum yang dilakukan oleh wartawan tehadap kasus anggota TNI yang melakukan tindakan menghalang-halangi wartawan dalam menjalankan tugas jurnalis dengan cara melakukan penganiayaan, mengadukan permasalahan untuk ditindaklanjuti dalam pemeriksaan perkara pidana atas dasar anggota TNI melakukan tindak pidana sebagaimana diatur dalam Pasal 18 UU Pers dan melaporkan kepada Dewan pers atas dasar telah melakukan tindakan melanggar kemerdekaan pers. Anggota TNI yang melakukan penganiayaan terhadap wartawan dalam mencari informasi dapat dikatakan telah melakukan satu perbuatan pidana tetapi melanggar dua peraturan perundang-undangan yaitu melakukan tindak pidana melanggar ketentuan Pasal 351 KUHP dan melanggar ketentuan Pasal 18 UU Pers. Terhadap tindakan anggota TNI tersebut maka kepada pelakunya dikenakan ketentuan yang diatur dalam Pasal 18 UU Pers atas dasar aturan yang bersifat umum dalam hal ini Pasal 351 KUHP dikalahkan oleh aturan yang bersifat khusus dalam hal ini Pasal 18 UU Pers yang dikenal dengan asas lex spesiale derogat lex generalis Kata kunci : Pers, TNI, Penganiayaan
